Any campaign finance disclosures, contribution certifications, contribution limits, tax disclaimers, or other legally required contribution language presented through the third-party contribution page or processor remain controlling for that contribution process.

6. Campaign Finance Compliance

By making a contribution through or in connection with the Website, you represent and warrant that you are legally permitted to make the contribution under applicable law and that your contribution complies with all applicable federal, state, and local campaign finance laws.

You acknowledge that political contributions may be subject to contribution limits, reporting requirements, source restrictions, and other legal obligations. You are solely responsible for complying with applicable campaign finance laws related to your contribution.

7. Volunteer, Event, and Campaign Update Submissions

Submission of a form does not guarantee:

We reserve the right to review, accept, reject, ignore, or follow up on any submission in our sole discretion.

8. Communications Consent

By providing your contact information through the Website, including through forms for campaign updates, volunteer opportunities, event registrations, or other campaign-related activities, you consent to receive communications from or on behalf of the Campaign Committee, including by email, phone, and text message, subject to applicable law and any consent language presented at the point of collection.

If you provide your mobile phone number, you understand and agree that you may receive recurring autodialed or prerecorded campaign-related calls or text messages, where permitted by law. Message and data rates may apply. Consent is not a condition of making a contribution.

You may opt out of certain communications at any time by:

  • following the unsubscribe instructions in an email,

  • replying STOP to a text message where applicable,

  • or contacting us at info@hernandeznm.com.

9. Acceptable Use

You agree not to use the Website to:

  • violate any applicable law, regulation, or campaign rule;

  • impersonate any person or entity or misrepresent your affiliation with any person or entity;

  • modify,

  • create derivative works from,

12. Suspension or Restriction of Access

14. Limitation of Liability

To the fullest extent permitted by applicable law, the Campaign Committee, and its officers, agents, volunteers, contractors, vendors, consultants, and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to:

  • your access to or use of the Website,

  • your inability to access or use the Website,

  • your reliance on Website content,

  • submissions made through the Website,

  • contributions processed through third-party platforms,

  • or your use of any Third-Party Service linked from or embedded in the Website.

If, notwithstanding the foregoing, liability cannot be excluded, the total aggregate liability of the Campaign Committee arising out of or relating to the Website or these Terms shall not exceed one hundred U.S. dollars (US $100.00).

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you to the extent prohibited by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless the Campaign Committee and its officers, agents, volunteers, contractors, vendors, consultants, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Website,

  • your violation of these Terms,

  • your submission of false or misleading information,

  • your misuse of any form or interactive feature,

  • or your violation of any law or the rights of any third party.

16. Governing Law

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of the State of New Mexico and applicable federal law, without regard to conflict of law principles.

17. Dispute Resolution

If a dispute cannot be resolved informally, any legal action arising out of or relating to these Terms or the Website shall be brought in a court of competent jurisdiction located in the State of New Mexico, unless applicable law requires otherwise.
